{"id":8415,"date":"2024-08-16T10:00:00","date_gmt":"2024-08-16T14:00:00","guid":{"rendered":"https:\/\/www.purdue.edu\/newsroom\/?p=8415"},"modified":"2024-09-13T15:01:20","modified_gmt":"2024-09-13T19:01:20","slug":"purdue-statement-on-aclu-suit-regarding-sea-202-aug-14-2024","status":"publish","type":"post","link":"https:\/\/www.purdue.edu\/newsroom\/2024\/Q3\/purdue-statement-on-aclu-suit-regarding-sea-202-aug-14-2024","title":{"rendered":"Purdue statement on ACLU suit regarding SEA 202 (Aug. 14, 2024)"},"content":{"rendered":"<div class=\"purdue-initial-words-wrap\"><p class=\"purdue-initial-words\">WEST LAFAYETTE, Ind. &mdash;<\/p> \n<p>Today Judge Sarah Evans Barker dismissed the case, agreeing with Purdue that the plaintiffs lack standing to press their claims under SEA 202.&nbsp;To be clear, Purdue never took a position on the merits of the plaintiffs\u2019 case, instead opting to make a procedural argument that the claims are not ripe, and thus the court did not have jurisdiction.&nbsp;Importantly, this was the&nbsp;<em>only<\/em>&nbsp;part of the Attorney General\u2019s brief that Purdue signed onto, and this is the argument that ultimately prevailed in court.&nbsp;To clarify its support of&nbsp;<em>only<\/em>&nbsp;the jurisdictional arguments in the AG\u2019s brief, Purdue filed the <a href=\"https:\/\/www.purdue.edu\/uns\/images\/2024\/240812SEA202-supplementalnotice.pdf\" data-type=\"link\" data-id=\"https:\/\/www.purdue.edu\/uns\/images\/2024\/240812SEA202-supplementalnotice.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">attached Supplemental Notice<\/a> with the court two days ago.<\/p>\n<\/div>\n\n\n<p>As the Supplemental Notice makes clear, and contrary to some media accounts, Purdue never wavered in its commitment to academic freedom and faculty tenure.&nbsp;In fact,&nbsp;Purdue trustees voted to&nbsp;<a href=\"https:\/\/www.purdue.edu\/newsroom\/releases\/2024\/Q2\/purdue-trustees-approve-faculty-promotions-and-transfers-reaffirm-commitment-to-academic-freedom-and-tenure.html\" target=\"_blank\" rel=\"noreferrer noopener\">reaffirm this commitment<\/a>&nbsp;in April, following a February&nbsp;<a href=\"https:\/\/www.purdue.edu\/newsroom\/releases\/2024\/Q1\/purdue-reaffirmation-of-academic-freedom-and-faculty-tenure.html\" target=\"_blank\" rel=\"noreferrer noopener\">letter<\/a>&nbsp;sent to all faculty.<\/p>\n\n\n\n<p><strong>About Purdue University<\/strong><\/p>\n\n\n\n<p>Purdue University is a public research institution demonstrating excellence at scale.
