Or, you can\u2019t see a favorable view at all because of that tree or unruly hedge. Or you are certain that the neighbor\u2019s tree will eventually fall onto your garage.<\/p>\n<p>Before you take any action, establish ownership of the tree, and find out if you have rights to work on the offending vegetation. Otherwise, it can land you into a contentious legal situation.<\/p>\n<p><strong>Some questions to consider include:<\/strong><\/p>\n<p><strong>When tree limbs or even the trunk of the tree crosses property line, are you within your rights to prune or remove it?<\/strong><\/p>\n<div id=\"attachment_16143\" style=\"width: 510px\" class=\"wp-caption alignright\"><a href=\"https:\/\/www.purdue.edu\/fnr\/extension\/wp-content\/uploads\/2020\/11\/Photo-2.jpg\" data-rel=\"lightbox-image-1\" data-rl_title=\"Photo-2\" data-rl_caption=\"Photo-2\" title=\"Photo-2\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-16143\" class=\"wp-image-16143 size-medium\" src=\"https:\/\/www.purdue.edu\/fnr\/extension\/wp-content\/uploads\/2020\/11\/Photo-2-500x444.jpg\" alt=\"propertyBoundry\" width=\"500\" height=\"444\" srcset=\"https:\/\/www.purdue.edu\/fnr\/extension\/wp-content\/uploads\/2020\/11\/Photo-2-500x444.jpg 500w, https:\/\/www.purdue.edu\/fnr\/extension\/wp-content\/uploads\/2020\/11\/Photo-2-768x682.jpg 768w, https:\/\/www.purdue.edu\/fnr\/extension\/wp-content\/uploads\/2020\/11\/Photo-2-250x222.jpg 250w, https:\/\/www.purdue.edu\/fnr\/extension\/wp-content\/uploads\/2020\/11\/Photo-2.jpg 1416w\" sizes=\"auto, (max-width: 500px) 100vw, 500px\" \/><\/a><p id=\"caption-attachment-16143\" class=\"wp-caption-text\">Check with local government websites for property maps which can help identify boundaries.<\/p><\/div>\n<p>Boundary laws vary with every state. Often the boundary lines are uncertain or assumed based on local information. However, in contentious situations that may result in major modifications to a tree, it is advised to get a survey to establish exactly who owns the tree.<\/p>\n<p>&nbsp;<\/p>\n<p>Rights are determined by who owns the tree. Check with your town, city, county and state municipalities for regulations about trees and property lines. The rights and responsibility for care and maintenance of trees are assigned to its owner, and ownership is determined by the\u00a0<em>location of the tree\u2019s trunk<\/em>. If the trunk is located entirely on the neighbor\u2019s land even if its limbs or branches overhang onto your land, the neighbor is the tree\u2019s owner. The neighbor has the sole right to preserve the tree or cut it down. This is true regardless of the neighbor\u2019s motivation or the impact the tree removal would have on your land.<\/p>\n<div id=\"attachment_16144\" style=\"width: 510px\" class=\"wp-caption alignright\"><a href=\"https:\/\/www.purdue.edu\/fnr\/extension\/wp-content\/uploads\/2020\/11\/Photo-3.jpg\" data-rel=\"lightbox-image-2\" data-rl_title=\"Photo-3\" data-rl_caption=\"Photo-3\" title=\"Photo-3\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-16144\" class=\"size-medium wp-image-16144\" src=\"https:\/\/www.purdue.edu\/fnr\/extension\/wp-content\/uploads\/2020\/11\/Photo-3-500x375.jpg\" alt=\"professionalArboristHelp\" width=\"500\" height=\"375\" srcset=\"https:\/\/www.purdue.edu\/fnr\/extension\/wp-content\/uploads\/2020\/11\/Photo-3-500x375.jpg 500w, https:\/\/www.purdue.edu\/fnr\/extension\/wp-content\/uploads\/2020\/11\/Photo-3-768x576.jpg 768w, https:\/\/www.purdue.edu\/fnr\/extension\/wp-content\/uploads\/2020\/11\/Photo-3-1536x1152.jpg 1536w, https:\/\/www.purdue.edu\/fnr\/extension\/wp-content\/uploads\/2020\/11\/Photo-3-250x188.jpg 250w, https:\/\/www.purdue.edu\/fnr\/extension\/wp-content\/uploads\/2020\/11\/Photo-3.jpg 2048w\" sizes=\"auto, (max-width: 500px) 100vw, 500px\" \/><\/a><p id=\"caption-attachment-16144\" class=\"wp-caption-text\">An ISA certified arborist can provide mitigation options that are best for the tree and helpful for the tree owner.<\/p><\/div>\n<p>It is always best practice and considerate to first ask your neighbor if you can arrange to have it removed or pruned. They might actually appreciate it.<\/p>\n<p>When tree work is required to remove or prune the tree and neighbor conflict exists, have a qualified tree care provider determine the work specifications on exactly how the tree issue should be mitigated. It is usually a bit more complex than simply stating, \u201ccut limbs back to property line.\u201d The work order must reference the ANSI A300 tree pruning standards to assure the procedures being proposed take into consideration the tree\u2019s future health. Ensure that your tree care provider has a copy of their current liability insurance policy on hand. Check their references as well, not all tree care companies are guaranteed to provide the best results for you or your tree.<\/p>\n<p>The best advice is to hire a tree care professional with the experience, expertise, and equipment to assess and safely prune, remove or otherwise care for your or your neighbors\u2019 trees.\u00a0Search for a tree care provider in your area.\u00a0Also, consider hiring an\u00a0<a href=\"https:\/\/www.treesaregood.org\/findanarborist\/arboristsearch\" target=\"_blank\" rel=\"noopener noreferrer\">ISA Certified Arborist which can be found here.<\/a><\/p>\n<p>According to most attorneys, open-minded communications with the neighbor can result in an acceptable resolution for any situation.
