Indiana State Laws

Ind. Code Ann. §§ 35-46-4-1 to 35-46-4-4

Enactment Date: 1988

Definitions:

Student-athlete — A person enrolled in a course of study in a public or private college or university who is eligible to participate in an intercollegiate sporting event, contest, exhibition, or program for the college or university in which the person is enrolled.

Agent Contract — A contract or agreement in which a student-athlete authorizes a person to negotiate or solicit on behalf of the student-athlete with a professional sports team for employment by a professional sports team or as a professional athlete.

Professional Sports Service Contract — A contract or agreement in which a person is employed or agrees to render services as a player on a professional sports team or as a professional athlete.

Recruitment Disclosure Requirement:

An athlete agent who knowingly or intentionally enters into an agent contract or a professional sports services contract with a student-athlete must give written notice, no later than 10 days before the contract is executed, to the head of the athletic department for the college or university in which the student-athlete is enrolled.

Penalty:

Failure to disclose recruitment is a Class D felony.
