Military Leaves of Absence, Re-employment Rights of Veterans and Employment of Substitutes - Clerical and Service Staff

The Board of Trustees has authorized the President of the University to grant leave of absence, without pay, to any member of the University staffs who has been employed in a regular, permanent position on the Clerical or Service Staff, and enlists or has been inducted into the Armed Forces of the United States, the National Guard of the United States, or the Public Health Service. Such leaves of absence will be granted on a year-to-year basis, not to exceed four years, effective each July 1, and with the understanding that the position will be available for these former staff members immediately upon their return from service.

Upon release from active duty, the employees described above should be reinstated in their positions without reduction in seniority, status, or pay except as such reduction may be made for all employees similarly situated. If the position which the employee vacated to enter service no longer exists, then the employee should be placed in a similar position with like seniority, status, and pay if at all possible. Such reinstatement shall apply to all employees who were in regular permanent positions and:

  1. Who have been drafted, provided they apply for reinstatement within 90 days after release from service and provided any voluntary service (after a period of service imposed pursuant to law) does not exceed four years.
  2. Who enlist or who re-enlist, provided they apply for reinstatement within 90 days after release from service and provided their total length of voluntary service does not exceed four years.
  3. Who are Reservists, re-entering active service other than for short training periods provided they apply for reinstatement within 90 days, and provided their total length of voluntary service does not exceed four years.
  4. Who are Reservists called to short periods of training duty provided they apply for reinstatement within 30 days after release from such duty.

Since there are circumstances which may warrant normal increases in pay, promotion, or other changes of status, the Personnel Office should be consulted when the rights of the reinstated veteran are in doubt.

University officials responsible for employment in the various departments should request Military Leaves of Absence for all members of the staffs entering military service. Military Leave status should be indicated on the payroll change forms terminating such persons from active employment; and a letter should be sent to the President recommending that such persons be on Military Leave of Absence so that this Leave may become part of the Trustees' records.

In making arrangements for employing a substitute while a staff member is on military leave, it should be clearly understood that appointment to the particular position is temporary and will terminate upon the return of the individual on leave. The University official should inform prospective substitute employees of this condition and should note it on all forms relating to the appointment of a substitute employee. Prospective substitute employees should also be advised that it is the policy of the University, upon the return of an individual from military leave, to transfer the temporary employee into a continuing position of comparable level whenever this can be arranged.

Leaves of absence, without loss of time or pay, for periods not exceeding fifteen days in any one calendar year may be granted by the President to any member of the Clerical and Service Staff who is regularly employed full time in a permanent position and who is a member of the Indiana National Guard or of the reserve components or the retired personnel of naval, air or ground forces. These leaves of absence shall apply only for such time as the National Guard members are in military training duties of the State of Indiana under order of the Governor as Commander in Chief or as members of any reserve component under order of a competent authority.

In the event two different periods of active duty are required of a staff member during one calendar year, approval for additional leave shall be requested by the department head, explaining the circumstances and reviewing previous periods of duty and leaves for this purpose.
