XLVI. APPROVAL OF REVISIONS TO REGULATIONS GOVERNING THE USE AND ASSIGNMENT OF UNIVERSITY FACILITIES AT THE WEST LAFAYETTE CAMPUS
Treasurer Ford asked the Trustees to consider a revision to Regulations Governing the Use and Assignment of University Facilities at the West Lafayette Campus. He said the proposed change is consistent with the revised Regulations Regarding Canvassing, Peddling, and Soliciting and the Delivery of Merchandise (Minute XLV, this meeting). Dr. Ford added that the Regional Campus Chief Business Officers have been reviewing the policy as it applies to their campuses and a policy proposal may be brought to the Trustees for approval in the fall.
Treasurer Ford recommended approval of the following revision (addition underlined):
3. General
- Use of University Facilities in any manner which results in financial gain, either directly or indirectly, to individuals or non University organizations or groups is prohibited, except for income earned from sales specifically approved in the revised regulations regarding canvassing, peddling, and soliciting and the delivery of merchandise, or for fees paid to performers or speakers. The amount and type of fees paid performers are to be approved by the Vice President and Treasurer or his representative . . . . .
After discussion and upon proper motion (July seconded, the Trustees unanimously approved the revisions to Regulations Concerning the Use and Assignment of University Facilities at the West Lafayette Campus in accordance with the Treasurer's recommendation.

XXX. APPROVAL OF REVISION OF REGULATIONS GOVERNING THE USE AND ASSIGNMENT OF UNIVERSITY FACILITIES AT THE WEST LAFAYETTE CAMPUS.
Assistant Treasurer Wise had mailed to the Trustees prior to the meeting a proposed revision of Regulations Governing the Use and Assignment of University Facilities at the West Lafayette Campus. Under Section 3.C. of the current regulations, the use of University facilities in a manner which may result in financial gain to individuals or non-University organizations or groups is prohibited. He reminded Trustees that in the past Purdue has negotiated contracts with performers solely on a. fixed-fee basis for payment of services. Only the University has sponsored the performances and all financial gains or losses have accrued to the University and not to individuals, non-University organizations or groups. He said that during recent years performers have been negotiating contracts containing other than the traditional fixed-fee payment. These variations are commonly referred to as Percentage contracts or first-money, second-money contracts. Mr. Wise added that it is becoming increasingly difficult, and in many cases impossible, for the University to negotiate fixed-fee contracts with performers. He explained that under the Bylaws of The Trustees of Purdue University, the Treasurer is authorized to approve contracts between the University and outside agencies.
Mr. Wise recommended approval of the proposed change to the Regulations Governing the Use and Assignment of University Facilities at the West Lafayette Campus as follows (change underlined):
3. General
- Use of University Facilities in any manner which results in financial gain, either directly or indirectly, to individuals or non-University organizations or groups is prohibited; except for fees paid to performers or speakers. The amount and type of fees paid performers are to be approved by the Vice President and Treasurer or his representative. Recognized student organizations may use certain University Facilities for activities involving paid admissions with the approval of the Vice President and Treasurer or his representative provided that such use will not result in financial gain, either directly or indirectly, to individuals or non-University organizations. Rental fees will be charged when appropriate.
After discussion and upon proper motion duly seconded and unanimously carried, the Trustees approved the revision of Regulations Governing the Use and Assignment of University Facilities at the West Lafayette Campus in accordance with the Assistant Treasurer's recommendation.
