Re: Revised Regulations Regarding Canvassing, Peddling, and Soliciting and the Delivery of Merchandise on the Campuses of Purdue University

The following revised regulations have been approved by the Board of Trustees. These regulations are being added to the Business Procedure Manual, Section 20. 04, Part IV of the University Code.

Article I - Authority, Application, and Effective Date

1.01		Authority. These regulations are hereby adopted pursuant to the authority conferred by law upon the Board of Trustees of the Trustees of Purdue University.
1.02		Application. These regulations as from time to time amended shall be applicable to all students and staff members of the University and shall be deemed a part of the terms and conditions of the admission and enrollment of students and of the employment of staff members. These regulations, as from time to time amended, shall also be applicable to all visitors entering the grounds of Purdue University, including the Lafayette and Regional Campuses.
1.03		Effective Date. These regulations shall become effective 9 November.
1.04		Revocation of Existing Rules. All previously adopted regulations, rules, policy statements and executive memoranda which are in conflict herewith are hereby revoked.

Article 2 - Definitions

2.01		Campus - All real property owned or occupied by the University including both the Lafayette and Regional Campuses.
2.02		University - Purdue University.
2.03		Person - Any student, staff member or visitor.
2.04		Staff Member - Any person, who is not a student, but who is employed temporarily or permanently, full or part-time, by the University in any capacity, including but not limited to, members of the faculty and members of the administrative, extension, service or clerical staffs of the University.
2.05		Student - Any person, who has registered in one or more undergraduate or graduate courses at the University, excluding, however, full-time staff members who are enrolled in courses for less than seven semester hours credit in the spring or fall terms or less than four semester hours credit in the summer term.
2.06		Visitor - Any person who is neither a student nor a staff member.
2.07		Solicitor - A person who seeks contribution for a fund or subscriptions for a newspaper, magazine or periodical.
2.08		Canvasser - A person who goes from place to place in an effort to take orders for goods or services.
2.09		Peddler - A person who goes from place to place with merchandise or services which he attempts to sell, whether for cash or on credit.

Article 3 - General Prohibitions

3.01		Deliveries of Foodstuffs. No foodstuffs shall be sold and delivered to the Purdue Memorial Union and the Memorial Center or to the areas surrounding these buildings. Food deliveries to any University residence hall or graduate house shall be permitted, but only when such deliveries are pursuant to a prior sale or order initiated by the customer and when such customer is among those to whom the delivery is made. Such deliveries shall be made only to public areas of the facility or to places legally accessible to automobile traffic adjacent to such facility. Deliveries of foodstuffs purchased or ordered, however placed, by relatives or friends of residents of the residence halls or graduate houses to commemorate birthdays or other special occasions shall be made to the applicable hall food office receiving room during normal hours for regular commissary foodstuff deliveries or to such other location or locations as the hall manager may designate, but no C. 0. D. orders shall be permitted. Food deliveries and sales shall be permitted in the Family Housing area subject to the controls set out in Article 7.
3.02		Peddling of Foodstuffs. The peddling of foodstuffs merchandise on any part of the campus (except the Family Housing area, which shall be subject to the provisions of Article 7, and except pursuant to the provisions of Article 4. 01) is prohibited.
3.03		Peddling, Soliciting and Canvassing. Except as hereinafter provided, peddling, soliciting, or canvassing of any product or service on any part of the campus is prohibited.

Article 4 - Exceptions

4.01		Student Organizations. Approved non-profit student organizations may, with the prior written permission of the Dean of Men and the Dean of Women, peddle, solicit and canvass on campus; provided, however, when such activities are to be conducted in University Residences or the Purdue Memorial Union, the additional prior written permission of the Director of these facilities shall be obtained. Such permission by any approving official may be restricted as to area, time and/or manner.
4.02		Staff Members. Subject to the provisions of Articles 3. 02, 6. 01 and 8.02, staff members may, with the prior permission of the Vice President and Treasurer, or his authorized representative, solicit, peddle or canvass on campus on behalf of charities officially recognized by the University; University-related social clubs; and professional and academic societies officially recognized by the University. Such permission may be restricted as to area, time and/or manner.
4.03		Magazines and Newspapers. The canvassing, peddling and soliciting of magazines, newspapers and periodicals (other than activities referred to under Articles 4. 02 and 4. 01) shall be permitted on campus; provided that: Soliciting shall be confined to subscriptions as opposed to direct sale of magazines, newspapers and periodicals. All solicitors must obtain the prior written permission of the Director of University Residences or the Director of Purchasing and Stores. In order to obtain a permit, the solicitor must show by satisfactory evidence that he is an official representative of the company he purports to represent. The Director of University Residences or the Director of Purchasing and Stores, in his discretion, may require either the solicitor or the firm he represents, or both, to post a bond payable to the University in the penal sum of $1, 000, executed by a surety acceptable to the Director of University Residences or the Director of Purchasing and Stores, or a cash bond of equal amount. The conditions of the bond shall be that the terms of all subscriptions sold by the solicitor shall be as represented and that he, or the firm he represents, will refund the full subscription price if not as represented. Such bond shall remain in force for a period of one year from the date the permit is granted, unless sooner released by the Director of University Residences or the Director of Purchasing and Stores. In the event the conduct of a solicitor proves disturbing to the living or study environment in the residence halls, or if the solicitor or his firm has been guilty of past misrepresentation, fraud, deceit, or unethical business conduct, the Director of University Residences or the Director of Purchasing and Stores may refuse to grant, or may suspend the solicitor's permit on a permanent or temporary basis. The permits may limit the area and the hours in which solicitors may operate.

Article 5 - Deliveries of Merchandise on Campus

5.01

General. Subject to the restrictions contained in Article 3 relating to delivery of foodstuffs, the delivery of merchandise pursuant to a prior sale or order, however placed, shall be permitted. With respect to a residence halls, graduate houses and the Union Club of the Purdue Memorial Union, however, deliveries shall be made only to the main office of the living unit unless the manager shall specifically designate another delivery area, and no C. 0. D. orders shall be permitted.

Article 6 - Purdue Memorial Union

6.01		Peddling, Canvassing and Soliciting. In addition to all other restrictions imposed by these regulations, and subject to the prohibitions of Article 3. 02, all peddling, canvassing and soliciting in the Purdue, Memorial Union, and the surrounding grounds shall be permitted only if approved in advance by the Director of the Purdue Memorial Union.
6.02		Exhibits. Exhibit activities conducted in conjunction with duly scheduled conferences shall be subject to the approval, as to the time, place and manner of such exhibits, of the Director of the Purdue Memorial Union.

Article 7 - Family Housing Area

7.01		General. Because of the community nature of this living area, it is deemed beneficial to permit controlled canvassing, peddling and soliciting as well as the delivery of merchandise, including foodstuffs.
7.02		Advance Permission. Prior to engaging in canvassing, peddling or soliciting (including student and staff organizations referred to in Articles 4. 02 and 4. 01) all persons must apply for permission from the Director of University Residences. Such permits, as may be approved by the Director, shall be issued at a cost of $5.00 each. The permit may limit the time, place and/or manner of such canvassing, peddling or soliciting and such limitation may be amended from time to time at the discretion of the Director. Permits issued to recognized charitable, religious and educational groups may be without charge if, in the opinion of the Director, a waiver of the permit fee is warranted.
7.03		Sundays and Holidays. No canvassing, peddling or soliciting shall be permitted on Sundays and legal holidays, or after 6:00 PM on other days. Only pre-scheduled, regular deliveries such as milk and newspapers shall be permitted on Sundays or legal holidays.

Article 8 - Miscellaneous

8.01		Display of Permits. All canvassers, peddlers and solicitors required to obtain a permit shall carry it with them at all times during the conduct of their business activities on the campus and shall display it upon the request of any University employee or any person with whom the canvasser, peddler and solicitor is transacting, or is attempting to transact his business.
8.02		Approval of Director of University Residences. In addition to all other restrictions imposed by these regulations, and subject to the prohibitions of Article 3. 02, all peddling, canvassing and soliciting in the residence halls and graduate houses and the surrounding grounds shall be subject to the advance approval by the Director of University Residences.
8.03		Terms of Permit. Each permit shall be valid for one year unless sooner amended or revoked.
8.04		Revocation of Permits. Any permit issued pursuant to these regulations shall be subject to revocation in the event of a violation of the terms of the permit regarding time, place or manner of canvassing, peddling or soliciting, or in the event of a violation of these regulations or any other University regulation now in effect or hereafter adopted. In cases of repeated or flagrant violations, the firm which the violator or violators represent may be banned from peddling, canvassing, soliciting or delivering on the campus.
8.05		Identification of Applicants. Any person authorized to issue permits under these regulations may delay the issuance of any permit until the applicant has produced satisfactory evidence that he is an authorized representative of the firm he purports to represent. In any case where the issuing authority deems it necessary, direct inquiry may be made with the firm an applicant purports to represent prior to the issuance of the permit.
8.06		Disclaimer. The issuance of any permit under these regulations in no way implies University endorsement of any product, service or cause and any representation to the contrary, express or implied, shall be cause for immediate revocation of permit.
8.07		Execution of Regulations. The Vice President and Treasurer shall be responsible for the execution and enforcement of these regulations through the appropriate University channels.
8.08		Special Services. These regulations shall not apply to those persons, firms or corporations who may negotiate with the Purdue University Purchasing Department and be awarded certain concessions or servicing privileges through written contractual arrangements. Nor shall these regulations apply to any activity conducted by the University itself.
8.09		Advertising. Distribution of handbills by commercial solicitors, canvassers or peddlers is prohibited. Other means of advertising which take place on the Campus (except advertising purchased in newspapers) shall be deemed a part of the activity the advertising seeks to promote and, as such, shall be subject to these regulations.
8.10		Regional Campuses. All authority granted under these regulations to the Dean of Men and Dean of Women is granted to the Dean and Director of each such Regional Campus, and all authority granted under these regulations to the Director of Purchasing and Stores and the Vice President and Treasurer (except that authority granted by Article 8. 07) is granted to the Business Administrator of each such Regional Campus.

Article 9 - Amendments

9.01		Amendments by Vice President and Treasurer. The Vice President and Treasurer is hereby authorized to amend these regulations during intervals between meetings of the Board of Trustees and such amendments shall be effective unless rescinded by the Board of Trustees.
9.02		Amendments by Board of Trustees. These regulations may be amended from time to time by the Board of Trustees.
